After some advice here.

Accepted a best offer on eBay on my Cup.
Car was listed exactly as it is will all good and bad bits clearly stated.

I made a particular note and use of the 'item description' box to highlight what I thought were the main defects. A small scratch on n/S panel being one of them.



Buyer claims this wasn't made clear enough even though that box sits directly under price.

He says it will need a respray, in his opinion.

Not the issue is that full eBay site shows this on the listing..


As does
EBay app



But the 'mobile Internet' version of eBay doesn't..


This is what he has been using to make an offer.
Now personally I'd look at an item of that price on the full site to avoid missing any info.

He now says he doesn't want it. I've lost out on fees, more fees to relist, if I do.

I don't want to be a c+*# but I'm sick of eBay Messers and wanted to get your opinion as the how I should/can proceed.

was it mentioned in the main description? i always tend to miss stuff in them bits to be honest at first, so he might have done the same. although i do go back and check stuff there afterwards

Ah well. It's not worth the ball ache. Under distance selling act he doesn't HAVE to buy it.
Will get a refund on listing fees from eBay and relist, showing it clearly in main description.

I believe it to be his fault for not reading the full description/ad in the correct format as EBay has many versions to cater for a variety of tablets/phones etc

I would never in a right mind not look at the full site potentionly spending that much.

Always the way unfortunately. Ebay is good for advertising, but next time list it as a classified add so people can harass you all day long offering you 30% of the asking price, but you won't be forced to pay FVF if you get people like this. You can simply just do any viewings and either of you walk away should you not agree.

It was up for very strong money for a Cup. I can imagine I'd be put off by something I wasn't aware of. I can sympathise he should have been aware, but it's unfortunate.

    I'd be blooming well shocked if I'd sold a car on e bay without any hassle.
    They bid and win the auction but for some reason they think that they was bidding on a viewing!

    You won't get a refund on the listing fees. I didn't when I sold the pussywagon and the buyer didn't even turn up.

    They did refund the final value fee but I was still down a tenner.

    IMO he's being a nob. He is buying a second hand car sight unseen off ebay FFS. It is not going to be perfect because it is at least 7 or 8 years old. If he expected a 2-grand car to be exactly as it was when it came out of the showroom in 2004-7 he's dreaming. There is bound to be a stone chip on the bonnet somewhere and you only said the bumper had stone chips, so he could have used that as an excuse too.

    If you mentioned the scratch in the listing and he didn't see it and didn't view the car before bidding then it is his fault. That's where the phrase "caveat emptor" (let the buyer beware) comes from. You didn't make him bid on it. If he had swiped that arrow next to 'Description' it is all there for him to read mobile app or not AFAIK.

    Since he's being a nob I'd go after him for the fees if you can. I can't remember what the Distance Selling Regulations say but I'd read them in detail if I were you. One of the secrets to life is always read the regulations/policy/laws and know them inside out, because most people don't bother and rely on other people to tell them as they are too lazy, so if you actually read them it gives you an edge over 95% of the population.

    There is a facility on ebay to cancel the sale but as said it may still cost you something in the end. Read that in detail too so you know how much he will owe you.

    I believe you are thinking of a 182. This example is ~11 years old.

    I was going to say, if you register the buyer simply as a non-payer and open a case against them unless they can prove they had good reason not to they will refund you.

    I had to ring them and argue it. They won't do it automatically.

    Worth a try.

    You could also ask about a Smart repair for the scratch - if it is easily fixed for under, say, £100 then his cancelling the sale on that basis looks even more ridiculous. People can do amazing things with paintwork these days. If you get a price for fixing the scratch, you could offer the scrote a choice between making the car with the scratch fixed or you opening a case against him to get your fees back.
