Cheers for all the responses guys.

I just found this on a website.....

'If you were not stopped and warned by the Police at the time of the offence, a Notice of Intended Prosecution (NIP) must be served on the registered keeper of the vehicle within 14 days of the incident. Court proceedings must be started within 6 months of the incident.'

I think on that basis, regardless of what everybody has said, I have no option but to just pay it since he warned me at the side of the road.

I just wanted to know where I stood and whether there were any loopholes I could exercise, but as is so often the case, there isn't! At the end of the day if I had of been paying attention and wasn't speeding then I wouldn't even be in this situation. So ultimately, this is the price I have to pay!

Cheers guys

Also..... the links simply state that it must be sent within 14 days, not actually received? i.e if the give it to the royal mail, and they take months sending it around the country etc... then they have still sent it, was similar with legal documents etc we used to send out from the bank, we still get blamed but have actually fulfilled our obligation, and would give a copy of our mail room copy with date stamps stating when it was sent Shut up Whistle

Correct, but you will notice I said my letter was dated 5 June and the date of offence was 3 May, so it didn't get caught up in the post Smile

There are ways of getting your own back...

Pay the fine, doesn't look like you have much choice.
However, we all know places where we've seen a mobile camera van or police car sat with a gun on numerous occasions, ALWAYS in the same spot.

Go down to B&Q, buy a box of 100 nails. Then go to that spot and scatter them all over the floor. Even if it costs them £50 a time to repair a couple of punctures, you've already cost them more money than they've cost you. Yes

Was there a speed camera sign within the 3/4 of a mile where u got caught, afaik there has to be by law a speed trap warning sign and if not they dont have a leg to stand on.

Or is that only for vans n gatsos?

I believe there only needs to be signs in spots where there are 'regular speed checks'.

They would argue that they hardly ever do speed checks where they caught me, and it was only a hand gun, not a Gatso or anything.

Besides, even if there did have to be signs, I doubt that would stick in court. Otherwise you couldn't have unmarked police cars driving around, same principle really!

There are no legal requirements for any signage at all regarding speed cameras.

There are recommendations for some scenarios, but these are not requirements.

Just pay up and take it on the chin. Regardless of wether you think they were w**kers for being there at the time, you and only you was in the wrong. You took the risk of speeding and you got caught. Accept it. The police have every right to stop anywhere they like with a mobile gun so you always have to be on the look out!

Not true as far as im aware. Fixed cameras have to be signed and van areas (they have defined areas. they cant just park up anywhere) have to be signed as well.

I do not believe this is a credible source of information.

The Traffic Signs Regulations and General Directions 2002 make no mention of requirements for such signs.

Which legislation do you believe covers this Stan?

Also, read section 4 of this from the DfT

Noting especially the last paragraph:

Compliance with these rules has no bearing on the enforcement of offences detected by the use of safety cameras. Non-compliance with these rules and guidelines by a partnership, or representative of a partnership, does not provide any mitigation of, or defence for, an alleged offence committed under current UK law.

Well i was actually told this by a judge who specialises in road traffic convictions so im certainly going to believe it and also i have noticed since i was told this that they do put signs where they put the vans.

The reason why the safety camera partnerships do sign all of their fixed cameras and mobile detection zones is because they are not allowed to collect revenue from cameras being operated outside of signed zones.

This of course has no bearing on cameras or mobile checks operated by the police directly.
