Hi chaps,

My mate has just been hit by a lorry on the M1. He was cruising along in the middle lane when a foreign lorry+driver pulled out from the slow lane into his lane and basically side swiped his car. Doing a fair bit of damage in the process.

These lorries seem to have big blind spots due to the left hand driving positions of their drivers and this seems to have been the case here where my mate was caught in his blind spot whilst the lorry driver started his manouvre....

Anyway the pics-









Its a 56 plate Seat Leon TDI with around 105k on the clocks.

Does anyone have an opinion if this damage is in 'write-off' territory?

He says he has got the insurance details of the lorry driver and is presently talking to his insurance provider.

Does anyone have any experience of this scenario? I.e where the fault lays in the eyes of the insurance companies?

Any advice welcome

I dont think so, not that he has spoken to anyway.

Traffic police came and spoke to him at the scene, said that in 99% of cases the fault lays with the lorry drivers.

Same happened to me with an Audi driver on the M4 - my insurance company have taken the stance that if they entered my lane then it's their fault.

Difference is that the dent is on my NSF wing and the damage is blatant that I've been pulled into - NSR could look like you've pulled across into their lane I suppose. Not sure how you get that damage there if you've been side swiped unless the other driver was attempting a PIT.
