That fact sheet is very clear - it is legal to retrofit HID lights onto a 306 only if they are purpose-designed HID headlights with e-marks, not conversions, and headlight washers and beam levellers must be installed. Just because a MoT tester does not spot HID conversions or the lack of beam levelling/washers does not make them legal. Non-compliant parts could cause other problems - e.g. they could be used by an insurance company to decline a claim citing unroadworthiness (current MoT or not), such as would happen if a vehicle had tyres worn below the minimum - even with a current MoT. It can't be fudged by saying "no-one's ever said anything at an MoT or thought the lights were too bright so it must be OK". It is taking a risk that it won't be found out, which is a very different thing from legal compliance.
