There are to be some changes to the MOT test from 1st January 2012 which are being introduced in response to European Commission Directive 2010/48/EU of the 5th July 2010 and which will effect those with aftermarket HID headlights and remapped ECUs:

4.1.4 Compliance with requirements:
(a) Lamp, emitted colour, position or intensity not in accordance with the requirements
(Cool Products on lens or light source which obviously reduce light intensity or change emitted colour
© Light source and lamp not compatible

4.1.5. Levelling devices (where mandatory):
(a) Device not operating.
(Cool Manual device cannot be operated from driver’s seat.

4.1.6 Headlamp cleaning device (where mandatory):
Device not operating.

For anyone with a remap, section 6.1.9 may be relevant.

6.1.9 Engine performance:
(a) Control unit illegal modified.
(Cool Illegal engine modification.

(by 'illegal', it is assumed that they mean changed/programmed differently from OEM specifications)

There will also be a new check on the general condition of the wiring:

4.11. Electrical wiring
(a) Wiring insecure or not adequately secured.
(Cool Wiring deteriorated.
© Damaged or deteriorated insulation

and on the function of airbag and seat belt pre-tensioner systems:

7.1.4. Safety belt Pre-tensioners:
Pre-tensioner obviously missing or not suitable with the vehicle.

7.1.5. Airbag:
(a) Airbags obviously missing or not suitable with the vehicle.
(Cool Airbag obviously non-operative.

7.1.6. SRS Systems:
SRS MIL indicates any kind of failure of the system.

Some of the above won't be popular with some around here I know, but VOSA have confirmed that the necessary changes to the MOT test schedule will be introduced and from 1st January 2012 vehicles that fall foul of the new requirements will fail the test.

Yes and no, there was a thread on this before. Fair enough airbags have to work if fitted etc, wiring not secured are kinda common sense.

However - ECU remapped? How the hell is the crappy garage down the road to my work going to be able to tell if I've modified my map? Clearly they're not. Wouldn't surprise me if this is more for the solder-in-line resistor type chip.

I've just read the rules here. The ECU gets a Visual inspection, I guess it is targeting piggyback devices and resisters.

The headlights rules are already in place.

bullshit i re-call. if this does happen then f*ck doing MOT's properly, i will just get ones made up and done for £50.

enough of all this EU shit.

does this mean i would have to get rid of the s/c or is it only after the changes are implemented.

although im sure you could just swap over ECU maps prior to MOT and just revert back after?

Exactly as people have mentioned, some random fitter at a garage is not going to know a standard ECU from a different one - they're simply looking for stupid resistors wired in and piggyback stuff.

Garages do not have the equipment to check if your car has been remapped or not.

Have these changes actually been adopted and are they going to be enforced for domestic (not commercial) vehicles?

The document referred to 'European Commission Directive 2010/48/EU of the 5th July 2010' is only recommendations!

They need to make re-mapping / modifications etc illegal before it can be enforced through the MOT test.

Hmm first I have heard of this and a lot of it seems hard to enforce, how are we as testers if this is true meant to know what each car has a specific ecu etc, I think someone is pulling peoples legs.

You have made a really good point it states "illegal" modification.

There are plenty of illegal modifications, HID's are currently for example.

No, it's a directive and the UK has to comply...

Until the relevant statutory instrument goes before Parliament and the Lords for passage into law it's just guess work as to how the UK is going to comply with this.

It's likely that VOSA will publicise the changes to the test as soon as procedures are agreed so we'll have to wait until then for a definite answer.

It's marked as a visual inspection so best guess at the moment is they will look for external signs of tampering on the ECU and for obvious modification to the ECU loom, so piggy back ECU's and ECU's that have had an access hole to the map chip cut into them will be almost guaranteed to fail.

VOSA have said they don't foresee the extra requirements adding much, if any, time to the current test as most of the new requirements are within the tester's view at some point during current test. It's only the ECU one that they've said needs further thought.

It may be the case that these ECU rules will only apply to type approvals after a certain date, or the Lords may argue that they aren't applicable in the UK at all... We'll just have to wait and see what happens.

basically that would mean no more modding is allowed as most serious mods, superchargers, turbo kits, engine conversions etc require an aftermarket ecu or a repap of the origonal, never going to happen in my oppinion, too much of a knock on effect.

Had my MOT in october with them on and it passed fine.

HID retrofits have always been a legal grey area; technically illegal but no clear method of enforcement. These new requirements will provide a method of enforcement.

It will be interesting to see if the police are told to enforce this at the roadside as without roadside enforcement it will just be another thing that people swap off for the MOT, such as decats.

but is it not illegal to drive a petrol car without a cat, so by looking underneath they can blatantly see a decat and no cat?

or is it all on the emissions?

Yeah, it's emissions. VOSA do roadside emissions tests sometimes but their enforcement team is relatively small.

It would break the type approval though, as it had to be sold with the converter fitted.

Decats are not illegal, but will probably cause you to fail on emissions.

Same as HIDs - they're not illegal per se, but if they leave your lights incorrectly aligned and impossible to realign, that's a fail.
